Navigating Kane County Fence Codes

Kane County has a unique approach: they specifically regulate "Privacy Fences" (anything you cannot see through) while being more flexible with open-style designs.

  • What Requires a Permit?

    • Privacy Fences: Any fence that cannot be viewed through or over (solid wood, vinyl, etc.) requires a building permit ($100 flat fee).

    • Open Fences: Split-rail, wrought iron, or chain-link usually do not require a building permit, but they dorequire a Stormwater Permit from Water Resources if they cross an easement.

  • Visibility Triangles: At intersections (within 100 feet of a centerline), no fence or hedge can exceed 3 feet in height to ensure sightlines remain clear for drivers.

  • Prohibited Materials: Electric fences and barbed wire are strictly prohibited on residential lots.

  • Finished Side Rule: Unlike some cities, Kane County allows the "finished side" of a fence to face either direction, though we typically recommend facing it out for the best curb appeal.

  • Post Depth: While not a strict county-wide mandate like in West Dundee, we sink all posts to a 36-inch minimum to ensure stability in the heavy prairie winds.

 

Hardscaping & Patios in the County

In unincorporated areas, managing water is the priority. Many homes rely on septic systems and well water, making the placement of your patio critical.

  • Septic Setbacks: We ensure all hardscapes maintain a 10-foot to 25-foot setback from septic tanks and drain fields to prevent damage to your waste system.

  • Stormwater Permits: For patios, the county focuses heavily on drainage. We coordinate with the Kane County Water Resources department (630-232-3497) to ensure your patio doesn't impede natural runoff.

  • Site Plan Waivers: If you don't have a modern Plat of Survey, we can often assist in submitting an Aerial Photo Site Plan with a waiver, saving you the cost of a new survey in certain rural circumstances.

 

Unincorporated Waste & Maintenance

Maintenance in the county depends on your specific township. We adapt our seasonal cleanups to fit your hauler:

  • Franchised Townships (e.g., Blackberry/Mill Creek): We coordinate with LRS for weekly yard waste and sticker-based collection.

  • Independent Townships (e.g., Aurora, Batavia, Campton): Because residents choose their own hauler (Groot, Flood Bros, etc.), we stage your debris exactly to your provider's specific requirements.

  • On-Site Solutions: For larger rural lots, we offer eco-friendly on-site debris management (mulching or composting) to avoid the high cost of stickers and hauling.
